Defenses for Disorderly Conduct

Posted on: November 6, 2014 by in Uncategorized
No Comments

Citations for “disorderly conduct” are pretty common in New York, especially in New York City.  The summons is used as a sort of “catch-all” for things you do that don’t rise to the level of a crime but are considered a violation nonetheless. Our domestic violence attorneys review what constitutes a disorderly conduct charge, and what you should do if you have been charged with being “disorderly.”

What does Disorderly Conduct Mean?

Disorderly conduct has a pretty broad spectrum. These violations can include:

  • Fighting
  • Noise Complaints
  • Obscene or Abusive Language
  • Disturbance at a Lawful Assembly
  • Blocking Traffic…Either Vehicular or Pedestrian
  • Failure to Disperse
  • Creating a “hazardous condition.”

So, as you see, there is a lot of room for interpretation in these cases.

Is Disorderly Conduct a Crime in New York?

Disorderly conduct is not a misdemeanor; it is simply a “violation.” Only felonies or misdemeanors are “crimes.” You should, however, take a disorderly conduct summons seriously. It can result in up to 15 days in jail, and some employment applications will ask about it. Avoid the stigma, jail time, and economic consequences by dealing with it accordingly.

What Should I Do If I Have Been Issued a Summons for Disorderly Conduct?

Don’t ignore it, thinking it will go away. The fastest and most efficient way of dealing with it is to contact an attorney that specializes in disorderly conduct cases. Lawyers are so familiar with these disorderly conduct cases, that their first plan of attack will be to have it dismissed. They will know their way around this type of summons, and the corresponding penal laws and statutes that apply.

What Will the Judge Be Looking for in the Case?

The main concern of the Judge will be the facts of the case, as outlined in the “fact” section of the summons. Your lawyer will be very familiar with the contents of the “fact” section, and will first try to get the case dropped because of “facial insufficiency” or because the facts do not warrant the summons.

If that strategy is not successful, your attorney will be prepared to argue mitigating circumstances as to why the case should be dismissed. They may argue that this infraction is actually based on innocent behavior. It’s possible that your background or work history may be used to form this argument.

Lean on Your Attorney’s Experience

Yes, you can lead your own defense against a disorderly conduct charge, but you run a real risk. Although the penalty cannot exceed more than 15 days in jail, do you want to risk that? Are you as familiar with the ins and outs of the laws and statutes surrounding disorderly conduct charges as your attorney will be? Are you prepared to argue the mitigating circumstances on your own?

The Truth About Disorderly Conduct Summons

Even though they are not a crime, your life can be upended on a disorderly conduct charge. You will have to take time to go to court, or even jail if that’s what the Judge decides. You can argue that the charge is too broad or not serious enough to warrant this action. But, the truth is, this can bring unwanted stress to your life. If you receive a summons, handle it quickly with the help of a domestic violence attorney and move on!

How Can a Defense Lawyer Help with My Domestic Violence Case?

Posted on: November 5, 2014 by in Uncategorized

Being charged in a domestic violence case is a serious situation. Depending on the severity of the crime you are charged with, you could be facing up to life in prison. Any time you face criminal charges, especially ones this serious, it becomes critical that you hire a good domestic violence lawyer immediately after being charged.

Why Hire an Attorney in a Domestic Violence Case?

Criminal defense attorneys have the experience necessary to determine the best defense to use in your case. The type of defense you use is probably the most important aspect of putting together your case. There are only so many types of defenses that you will be able to use, so choosing the right one is pivotal to your case.

Potential Defenses in Response to a Domestic Violence Charge

It’s important to remember that even though we’re calling this a “domestic violence” case, that is not the crime. You will be tried for the actual crime that was committed against the person you have a domestic relationship with at the time you were arrested. The most common defenses used in these cases are:

You Have the Wrong Suspect – You contend that although you acknowledge that the crime took place, you maintain that you are not the one responsible.

Charges are Deliberately False – Common in custody and divorce cases, complaints will be lodged against a spouse or ex-spouse that are untrue. These charges are often filed in spite against the other person.

Self-Defense – This is a common defense in domestic violence cases, where those accused of the crime will insist that they did it to protect themselves or their children.

Consent – Remember that domestic violence charges can result from accusations of sexual misconduct or rape. The defendant may insist that they had consent for the actions that took place.

Lack of Proof – The burden of proof falls on the prosecutor in criminal cases such as these. If the defense attorney can show that there are holes in the prosecutor’s case, they are going with this defense strategy.

How Does Your Lawyer Decide Which Defense Strategy to Use?

So, a criminal defense attorney who is experienced in domestic violence cases decides on which defense will be most effective by collecting information and doing an in-depth analysis of the documents surrounding the complaint. Specifically, they may look for answers to the following questions while reviewing the police report:

  • Does the 911 record weigh for or against my client?
  • Were there any witnesses?
  • Does my client have a history of violence against anyone?
  • What statements has my client already made?
  • Is there medical evidence that goes against my client’s statements?
  • Is there any sign of drug or alcohol abuse by either party?

Answers to these questions and more, combined with confidential information taken from the client, will be instructive as the defense attorney constructs your defense against the charges.

A Criminal Defense Lawyer is Necessary When You’re Facing Domestic Violence Charges

As you see from this discussion, failing to defend yourself against these serious charges could be disastrous. If you are involved in a domestic violence case, you need an attorney. Hire the best domestic violence lawyer you can afford.

How New York is Handling the Opioid Crisis

Posted on: November 4, 2014 by in Uncategorized
No Comments

Addiction to opioids is increasingly killing residents of New York and the United States, according to our drug crime attorneys. Victims take the drug either knowingly or unknowingly. One problem is that opioids might be in a medicine cabinet in your home in a painkiller your doctor prescribed. Here are some steps New York is taking to curb this menace.

Governor Cuomo Announced Federal Grant

New York’s Governor Cuomo has announced rolling out $25.2 million funded by the Federal Government. This fund is intended to extend steps taken to fight against opioids. The millions will be used towards enhancing services geared to the treatment of victims of disorders related to using opioids. Services to be expanded are: medicinal treatment, mobile treatment, tele-health, supporting recovering addicts, and preventing opioids from finding their way into New York.

The Governor has gone further to create a task-force to fight opioid and heroin addiction. There are 16 counties targeted and described as high-need in New York. Some of these high-need counties are: Niagara, Tompkins, Cayuga, Tioga, Jefferson, Saratoga, Oswego, and Sullivan. These counties will receive $1.8 million more to train those who will be providing medicinal treatment to recovering addicts, as well as training on the use of naloxone, an opioid antidote.

A Reformed Health Insurance

Reforms in the health insurance sector took effect on the 1st of January 2017, after an announcement was made by the New York Governor. The reforms are directed at fighting the ongoing opioid and heroin crisis. Governor Cuomo signed a legislative deal that demands health insurance plans cover the cost of treating opioid addicts. The deal also limits doctors from over-prescribing opioids in New York. It also extends ways to prevent opioids within communities and increases better access to medication.

These reforms will remove limitations which prevent the citizens of New York from getting help. They have outlined better precautions to get opioids off the streets. The deal includes best practices recommended by Governor Cuomo’s heroin and opioid task force. The reforms remove the burden that was there to patients seeking treatment and medication as in-patients. The new Law stipulates that insurance authorization is not necessary before a patient is admitted as an in-patient. As long as a patient needs treatment, insurance firms are required by law to cover in-patient treatment cost for substance users; and all disorders associated with their use.

NYPD Fights Back to End Opioid Crisis

Cases of opioid-related overdoses and deaths are reported to the New York Police Department every day. That is why the NYPD is determined to reverse this situation by taking steps towards eradicating opioids permanently. On Staten Island, the NYPD started a program where its officers are required to carry naloxone. It is meant to reverse the effects of an overdose of opioid. They have trained over 17,000 officers spread throughout New York City. NYPD has saved over 140 lives using naloxone excluding emergency medical teams and hospitals.

NYPD investigates all reported cases of opioid overdose to find out whether a person bought it illegally on the street, or from a doctor’s prescription. It has 84 officers to carry out investigations and to specifically deal with opioid-related cases. The borough narcotics squad has 64 officers to cover NYC; 20 officers will be based at the Criminal Enterprise Division. They work with the FBI to investigate complicated opioid crimes.

Use Caution When Taking Pain Killers

Opioids have continued to destroy lives in NYC for years. Take prescribed painkillers only when necessary, and use caution when taking them. It’s easy to get caught up in the cycle of addiction. The opioid crisis will not go away overnight, but states like New York are implementing new strategies to offer residents relief from the epidemic, as well as decrease the overdoses and deaths plaguing cities across the US.

Prescription Drugs and Drug Crimes

Posted on: November 1, 2014 by in Uncategorized

Many people who take medication prescribed to them by their doctor can get addicted to it without knowing, according to our drug crime lawyers. After all, you usually follow your doctor’s advice without question. A lot of medicines that are prescribed are extremely addictive. Patients who develop an addiction always need medicine and may try to get these medications using fake prescriptions or buy them illegally. Here are some facts about the prescription drug epidemic that you might not be aware of that is occurring across the United States.

Abusers of Prescription Drugs

People of all ages get into the unlawful use of prescription drugs. Surveys indicate that an alarming number of US citizens, aged 12 and up, have abused prescribed medication at some point in their lives. Millions of teens and youths between 12-17 years old are currently abusing prescribed medicine. Young adults aged 18-25 are also abusing prescription drugs in record numbers.

Prescription medication abuse among students in high school is alarming. What’s more alarming, is that this is not a young person’s problem anymore. Productive adults are being dragged into the prescription drug abuse circle in record numbers.

Abused Prescription Drugs

Prescription drugs are widely abused in the US because they can be accessed easily, and are highly addictive. They are also a cheap alternative to changing a user’s state of mind and body depending on the type of drug one is abusing. Prescription stimulants are used to treat Attention Deficit Disorder (ADD). They are normally prescribed to children who attend school. An example of a prescription stimulant is Methylphenidate. It contains Ritalin which has similar effects to cocaine. Amphetamine is another stimulant just like Methylphenidate. Alprazolam or Xanax and diazepam otherwise called valium are the most abused prescription drugs. These drugs are commonly prescribed to reduce anxiety and are being prescribed to patients in record numbers. Habitual users can take as much as 30 pills in a day, which creates a great demand for the drugs by addicts.

Crimes Associated with Prescription Drugs

Prescription drugs are the main reason why crime and addiction areincreasing in the United States, despite continued efforts to help addicts seek treatment rather than committing crimes to fund their addictions. Desperation leads to crime, even in “good” areas. In the past, the police were concerned with more traditional crimes; they now want to know what’s in the cabinet where you store your medicine.

Residents addicted to prescription drugs are targeting seniors and the sick in their homes. They are raiding these homes where they are sure to find medicine in the cabinet to steal. This type of crime is so common that the police in some areas are asking residents to give up bottles of strong medicine. In one incident, a man followed an elderly lady coming from a drug store at 9:30 PM to the parking lot. He removed a knife and demanded the senior citizen give him her medicine. The lady started to scream and attracted night guards nearby. The man was found with 1,000 Oxycontin pills in his back-pack.

One way the demand is met for prescription drugs is where dealers operate “pill-mills” often called “pain management clinics.” Doctors sell potent painkillers in exchange for money. Recently, a man was accused of murdering his wife in bed while she was sleeping. He said his actions were caused by a pill, doxylamine, that he was taking to help him sleep. A doctor present in that court said that doxylamine could cause you to act completely different.

Protect Yourself from Prescription Drug Addiction

Prescription drugs are meant to be taken according to doctors’ orders. If you find yourself in need of them after the appropriate time has passed, or if you seem to need a higher dose than has been prescribed, then it’s time to ask for help. The prescription drug epidemic has encouraged the creation of many treatment facilities. Seek help as soon as you feel it’s a problem so that you can prevent further damage to your health and life.

Drug addiction has been a problem for families and society in general for years. Drugs don’t discriminate…the menace of drug addiction affects the young and old, rich and poor, male and female, across all levels of education, cultural and racial boundaries, and social upbringing in the United States. No one is safe. If you would like to help someone who is an addict, or you want to get help and start the recovery journey yourself, you’re in the right place. Here is a list of well-known rehabilitation centers in New York provided by our drug crime lawyers that you can go to when seeking treatment.

Mount Sinai West

Mount Sinai West rehab has been in existence for over 40 years doing research, training, and treating patients. This center for healing is on Manhattan’s West-side. It is a well-respected institute of addiction recovery, focused on providing services to people who are struggling with substance abuse and addiction disorders. It’s a part of St. Luke’s Roosevelt Hospital Center and is also an affiliate of Columbia University College of Surgeons and Physicians. The psychiatric section deals with detoxing and stabilizing in-patients combined with caring for out-patients.

Immediately after a client is admitted, he/she is evaluated by a psychiatric doctor. Patients who need medical help, or need to be stabilized in order to cope with symptoms of withdrawal, undergo a detox program as an in-patient. To detoxify a patient’s body takes up to a week. Patients are treated using the latest technological methods for addiction recovery. Patients treated on an out-patient program will have their treatment plan customized according to their needs.

Shalom Jewish Recovery Institute

This Jewish Recovery Institute’s approach to drug addiction treatment is unique. Patients are not allowed to see each other; one clinician is supposed to tend to the needs of eight patients at a particular time. Each individual lives in 1,500 sq. ft. of luxury facing New York City’s sky and the Central Park.

Clients frequently leave the facility to walk through Manhattan as part of a treatment plan known as ‘sober references.’ At the Jewish Recovery Institute, patients go to the fine restaurants of Manhattan and have their meals. As a patient in this rehab, you are encouraged to visit museums and galleries to see art in the city of New York. Feeding the needy is also part of the treatment; it’s intended to remind you how to help others. You will be flown from wherever your house might be to the rehab and back once your treatment is over. Privacy is a priority at Shalom; they do not advertise instead they rely on references from past clients. Individual treatment and privacy is their specialization.

New Hope Manor Inc.

New Hope Manor Inc. is a drug rehabilitation and treatment center offering personalized treatment and counseling. Patients who have completed their treatment plan form groups to prevent them from relapsing. Career guidance is available, and meetings and seminars are frequently held to enlighten family and friends of patients on how to live with them after recovery.

This rehabilitation is unlike others because it only accepts women. Expectant women and young girls will get help here. Young girls with children less than three years are accepted and rehabilitated in this institution. Clients referred from other rehabs are accepted, and the clinicians make sure the transition goes as planned. Some of New Hope’s patients are employed, and others struggle with unemployment. Some are students during the day and come for treatment after class. All clients are expected to respect and support each other in the center. The best part is that no patient will be turned away for inability to pay.

How You Can Help with the Drug Addiction Problem

Recovery after the healing is an ongoing process; patients need to be supported and loved through it. Recommend a rehabilitation center to anyone you know who is struggling with addiction and help to save their life.
